Yeah, I know that the statue outside Dumbledore's office is a griffon, not a pheonix, but who's to say that the statue is of a pheonix? It does look remarkably like the statue outside the office in the movie after all..
And I know that the title is Order of the Pheonix, but from the books that I've got, none of the covers seem to be linked to the titles as such anyway...
No 1, has got the hogwarts express, not the philosophers stone on it,
No 2, the flying car, not the chamber of secrets,
No 3, Buckbeak with Harry and Hermione on it, not Sirus,
No 4, the Hungarian Horntail, not the Goblet of Fire...
So why do we think that the statue has to be a pheonix???
