He ROCKED in the film. Mostly because you never really knew where he stood. Ultimately, he outsmarted everybody - stealing the Interceptor right out from under the navy, taking the curse on knowing it would protect him in battle, and breaking the curse when the pirates were vulnerable.
Also, piracy is often a matter of perception - at least historically. Francis Drake was a hero of England, but considered a pirate by other countries. During the United States involvement in the Napoleonic War (war of 1812 by US standards), the US considered England to be pirates by boarding their vessels looking for English subjects not drafted into the war.
For the record, I absolutely LOVE the Disney attraction.
