I noticed this too! Maybe only 1st year prefects can't take points away. Percy was in his 6th year-not 5th-when he took those points away from Ron. But Hermione was also a 6th year when she had that run-in with the fanged-frisbee boy. Maybe Percy's points taking away was just an empty threat! :-)

Maybe the rules changed, sometimes prefects get more power don't then when the school is in special danger...perhaps the prefects were allowed to take points away that year because Dumbledore needed more eyes keeping the pupils safe?

Yeah! Or maybe Dumbledore thought they had to much power so he said that they couldn't take away points!

Prefects can take points. Been confirmed by JK Rowling. She just said that Ron wasn't a very model prefect and didn't think he could.

Personally I think she forgot, but it's not important. They can - 'tis confirmed.
